The Domestic Upside

Useful protection may start with familiar tools in the United States.

The domestic upside is about making good use of the tools available at home. U.S. law provides companies, partnerships, LLCs, and—in some states—asset protection trusts.

These tools can serve different purposes and can work together. An LLC may help separate a business risk. A partnership may organize ownership and management. A trust can add rules around who benefits from assets and how.

The recording’s point is that you may be able to build a useful level of protection without taking on a fully foreign trust. Some domestic structures may cost less and feel simpler to maintain.

A domestic asset protection trust can also avoid the foreign-trust reporting duties that arise from being classified as a foreign trust. That does not mean there are no taxes, forms, fees, or other obligations.

The upside is practical: local arrangements, familiar service, and potentially less ongoing work. You should use the domestic tools that fit your needs.

But a practical upside is not the whole story. Domestic tools remain inside the U.S. legal system. The next lesson explains the limitation that the series calls “The Domestic Fatal Flaw.”
